Terms of Service

These terms are the agreement between you and Point and Sell, run by Winston Burbage in Chandler, Arizona ("we", "us"). By creating an account or using the site you agree to them. Questions go to [email protected]. How we handle your data is on the privacy page, which is part of these terms.

What the service does

You photograph comics, books, records, games and figures. We identify each one, build listings from the photos and your settings, and hand you a file for eBay, Whatnot or Shopify, or, when you press the button for it, send it to eBay or your Shopify store for you. Nothing is listed until you have reviewed it and approved it.

You are the seller

Every listing is yours: you decide what to sell, at what price and in what condition, and you are responsible for it being accurate, legal and allowed by the marketplace you sell on. Identification, titles, item details, condition lines and price suggestions are made by software, including an AI model and third-party price guides, and they can be wrong. Check every row before you approve it. We are not a party to any sale, and we do not handle buyers, payments to you, shipping or returns.

Connecting eBay and Shopify

When you connect your eBay account or your Shopify store, you let us act for you only in the ways the site describes where you connect: reading your listings, orders, views and fees, hearing about sales, sending the files you choose to send, and changing store stock when a comic sells elsewhere. eBay's and Shopify's own terms still apply to you. They can change or withdraw what they let apps do, and when they do, a feature may stop working. You can disconnect at any time.

Your account

You sign in with a link or code sent to your email address, so keep that mailbox secure. On the Shop plan the account's owner decides who is added and is responsible for what they do in the account. You must be old enough to make a binding contract where you live.

Plans and billing

• Plans are counted in listings a month. A comic, a lot, a book, a record, a game or a figure is one listing each. The plans differ in how many listings they include, and the Shop plan lets several people work in one account.
• Your first 50 listings are free. After them, or after 30 days, whichever comes first, the plan you pick starts on the card you enter. Cancel before either and pay nothing. There is one free trial per account.
• Plans renew every month on the card on file until you cancel. Payments are taken by Stripe. Enterprise accounts are invoiced as agreed with us.
• Cancel or change plans any time from the plan page. A plan change takes effect as soon as you confirm it, and Stripe shows what it will charge or credit before you do. A cancelled plan stays active until the end of the month already paid for.
• We do not refund charges already made, except where the law requires it. If something went wrong, write to us and we will look at it.
• We may change prices. A change to your plan's price is emailed to you at least 30 days before it applies to you.

Your photos and listings

What you upload stays yours. You give us permission to store it, process it and send it to the services named on the privacy page, only to run the service for you. Upload only photos you have the right to use.

What you may not do

• List counterfeit, stolen or illegal goods, or anything the marketplace forbids.
• Try to reach another seller's account or data, or get around the limits of your plan.
• Overload, attack or copy the site, or resell it.

We may suspend or close an account that does, and one whose payment fails and is not fixed.

Changes and availability

We keep improving the service, so features change. We work to keep it running, but we do not promise it will always be available or free of errors. If we change these terms in a way that matters, we email you at least 30 days before the change applies.

Ending the agreement

You can stop using the service and cancel at any time; to have your account deleted, follow the privacy page. We can end the agreement with 30 days' notice by email, or at once for a serious breach of these terms.

The limits of our responsibility

The service is provided as it is. To the extent the law allows, we are not responsible for lost sales, lost profits, a listing's price or accuracy, or anything a marketplace does to your listings or account, and our total responsibility for any claim is limited to what you paid us in the twelve months before it. Nothing here limits a responsibility the law does not allow to be limited.

You agree to cover us for claims made against us because of what you listed or sold.

Law

These terms are governed by the laws of the State of Arizona, and any dispute goes to the state or federal courts in Maricopa County, Arizona, unless the law where you live says otherwise.
